Terms of Service

Welcome to MenuHoster. These Terms of Service (“Terms”) govern your use of the MenuHoster platform, website, and services (collectively, the “Service”). By accessing or using MenuHoster, you agree to be bound by these Terms.
Acceptance of Terms
By creating an account, uploading menu content, or using any part of MenuHoster, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
Eligibility and Account Registration
You must be at least 18 years old and capable of forming a binding contract to use MenuHoster. By registering, you represent that all information you provide is accurate and current.
You may create an account using:
- Email and password
- Google account login (OAuth)
- Facebook account login (OAuth)
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@menuhoster.com if you suspect unauthorized access.
Plans, Billing, and Cancellations
MenuHoster offers multiple subscription plans:
Free Plan — $0 per month
- 10,000 menu views per month
- 10,000 QR code scans per month
- 1 active menu
Pro Plan — $19 per month (or annual/lifetime)
- 50,000 menu views per month
- 50,000 QR code scans per month
- Up to 15 active menus
- Customization features and custom QR branding
- Advanced analytics
- Priority support
- Blue verified badge
Max Plan — $39 per month (or annual/lifetime)
- 100,000 menu views per month
- 100,000 QR code scans per month
- Up to 50 active menus
- Export analytics data
- Dedicated support
- Early access to new features
- Gold verified badge
Billing Terms
- Monthly plans are billed on a recurring basis until canceled.
- Annual plans are billed once per year and offer savings over monthly billing.
- Lifetime plans are one-time payments that provide access to the Service for as long as MenuHoster operates and the plan tier remains available. Lifetime plans do not guarantee perpetual access or that the Service will exist forever.
- Active menus are those published and publicly viewable. Draft menus do not count toward your limit.
- If you exceed your plan limits (views, scans, or active menus), we will notify you and provide a reasonable opportunity to upgrade. We will not abruptly remove your menus without notice.
Cancellations and Refunds
You may cancel your subscription at any time from your account dashboard. Cancellations take effect at the end of your current billing period. We do not provide refunds for partial months or unused time, except where required by law.
User Content
You retain ownership of all content you upload to MenuHoster, including menus, photos, PDFs, business information, and descriptions (“User Content”).
By uploading User Content, you grant MenuHoster a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your User Content solely for the purpose of providing and improving the Service.
Prohibited Content
You may not upload or share content that:
- Violates any law or regulation
- Infringes on intellectual property rights of others
- Contains malware, viruses, or malicious code
- Is fraudulent, deceptive, or misleading
- Contains hate speech, harassment, or threats
- Depicts or promotes illegal activity
MenuHoster reserves the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is inappropriate or harmful.
Public Pages and Sharing
When you publish a menu on MenuHoster, it becomes publicly accessible via:
- A unique hosted URL (e.g., menuhoster.com/your-restaurant-name)
- A QR code that directs to that URL
Your published menus, business name, descriptions, and any information you choose to display are visible to anyone who visits the URL or scans the QR code. You control what information appears on your public menu pages.
The “Call Restaurant” button on menu pages uses the phone number you provide. You are responsible for ensuring this information is accurate and up to date.
Analytics
MenuHoster provides analytics on menu views, QR code scans, time trends, and other usage metrics. Analytics are provided for informational purposes and may not be 100% accurate. We do not guarantee the precision or completeness of analytics data.
Verified Badges
Pro and Max plan subscribers receive verified badges (blue and gold, respectively) displayed on their menu pages. These badges indicate an active paid subscription and are intended to build customer trust.
Verified badges do NOT constitute:
- An endorsement by MenuHoster of your business practices
- A guarantee of food safety, quality, or regulatory compliance
- Certification or accreditation of any kind
Badges are removed if your subscription lapses or is canceled.
Acceptable Use
You agree to use MenuHoster only for lawful purposes and in accordance with these Terms. You will not:
- Use the Service to engage in illegal activity
- Attempt to gain unauthorized access to MenuHoster systems or other users' accounts
- Scrape, crawl, or use automated tools to extract data from the Service
- Impersonate MenuHoster, our employees, or other users
- Interfere with or disrupt the Service or servers
- Use the Service to distribute spam, phishing attempts, or malware
- Reverse engineer or decompile any part of the Service
- Resell or redistribute the Service without authorization
Violations may result in immediate termination of your account.
Intellectual Property
MenuHoster, our logo, trademarks, and all related content (excluding User Content) are the property of MenuHoster and protected by intellectual property laws. You may not use our intellectual property without prior written permission.
Third-Party Services
MenuHoster integrates with third-party services, including:
- OAuth providers (Google, Facebook) for account authentication
- Payment processors for billing
- Hosting and content delivery services
- Analytics services
Your use of these third-party services is subject to their respective terms and privacy policies. MenuHoster is not responsible for the practices or policies of third parties.
Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Termination
By You
You may close your account at any time from your dashboard or by contacting support@menuhoster.com. Upon account closure, your public menus will be removed from the Service.
By MenuHoster
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or abusive behavior
- Fail to pay fees when due
- Use the Service in a manner that harms MenuHoster or other users
We will provide notice when reasonably possible, but reserve the right to terminate immediately in cases of severe violations.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MENUHOSTER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee:
- Uninterrupted or error-free operation
- That the Service will meet your specific requirements
- The accuracy or reliability of analytics data
- That defects will be corrected
You use the Service at your own risk.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENUHOSTER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL MENUHOSTER'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO MENUHOSTER IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitations on certain warranties or liabilities, so the above may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless MenuHoster and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any rights of another party
Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice on the Service. Continued use of MenuHoster after changes take effect constitutes acceptance of the revised Terms.
Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
